Policy for Combating Violence and Harassment at Work
Law 4808/2021 and specifically articles 2 to 23 ratified Convention 190 of the International Labour Organization on the elimination of violence and harassment in the world of work, as adopted by the Conference of 21 June 2019. The aim of these regulations is to set a coherent and modern framework for preventing, addressing and combating violence and harassment, contributing to the creation of a working environment that respects, promotes and implements in practice the right of everyone to a world of work free from violence or harassment.
IntelliSoft is committed to ensuring that all its Executives are treated fairly and with dignity and respect. An important part of this commitment is to provide a working environment free from harassment, bullying and unlawful discrimination, thus laying the foundation for a productive and positive workplace.
This Policy sets forth relevant definitions, core principles, and IntelliSoft's commitment to eliminate harassment, intimidation, and unlawful discrimination within its premises, and includes employees, customers, and visitors.
Violations of this Policy will be treated seriously and will be dealt with in accordance with the Relevant Legislation.
Harassment
Harassment is unwanted behavior that intimidates, insults, or humiliates an individual or group of people, based on race, color, gender, age, sexual orientation, disability, or other characteristic protected by any Antidiscrimination Law.
Harassment (including sexual harassment) is determined by the nature and consequences of the conduct, not the intent of the inspirer, and occurs in situations where a reasonable person would expect the conduct to be offensive, humiliating, or intimidating.
The harassment can be repeated or be a one-off incident.
Harassment includes, but is not limited to:
- Verbal abuse or comments that oppress or stereotype certain groups
- Personal insults, comments or innuendo
- Aggressive communications, including digital communications such as social networks and e-mails.
Sexual harassment
Sexual harassment is unwanted behavior of a sexual nature that makes a person feel insulted, humiliated and intimidated. Certain forms of sexual harassment, including sexual assault, indecent exposure, stalking and obscene communications, may constitute a criminal offence. Bullying Bullying is defined as repeated and irrational behavior directed towards an individual or group of people that poses a health and safety risk. It refers to behavior that is victimizing, humiliating, intimidating, or threatening.
Bullying
Bullying is defined as repeated and irrational behavior directed towards an individual or group of people that poses a health and safety risk.
It refers to behavior that is victimizing, humiliating, intimidating, or threatening. Whether a behavior is irrational may depend on whether a reasonable person can see the behavior as irrational under the circumstances.
Bullying can be overt or hidden. Examples of behaviour that may be perceived as intimidating, posing a health and safety risk, may include:
- Physical or verbal abuse
- Yelling, screaming or offensive language
- Unjustified criticism or complaints
- Psychological harassment
- The intentional exclusion or isolation of workers from activities in the workplace
- Hide information that is vital for effective work performance
- Imposing unreasonable schedules and constantly changing deadlines
- Denying access to information or resources so as to harm an employee
- Spreading misinformation or malicious rumors
- Changing work arrangements, such as leave, to intentionally target a specific employee
- Excessive control at work
Conflicts in the workplace
Conflicts in the workplace, including differences of opinion and disagreements, are generally not workplace bullying. People can have differences and disagreements without engaging in repeated, irrational behavior that poses a risk to Health and Safety. However, in some cases, the conflict can escalate to the point of becoming workplace bullying. Therefore, it is important that the conflict is not ignored and, where possible, resolved to avoid escalation.
Distinction
Discrimination occurs when one person is treated less favourably than another person because of certain qualities (direct discrimination) or when a requirement that is the same for all has an unfair effect on certain individuals because of a specific characteristic (indirect discrimination).
According to current legislation, discrimination against people in various areas of public life is reprehensible due to:
- Ethnic identity
- Color
- Sex
- Sexual orientation
- Pregnancy
- Age
- Physical or mental disability
- Marital status
- Religion
- Political orientation
- Social origin
All of the above acts may:
- create an intimidating, hostile, offensive or painful work environment
- Adversely affect the health and performance of an individual or groups of employees
- Lead to reduced productivity
- Result in the loss of experienced and qualified employees through resignation
- Negatively affect a person
- Negatively affect an individual's recruitment, level of appointment, promotion and opportunities for advancement
- Negatively affect an individual's access to or participation in a range of opportunities
- Damage the image of the Company.
IntelliSoft expects all members of its executive workforce to ensure that their behavior meets appropriate standards and contributes to a productive workplace.
All IntelliSoft members have:
- Right to work, in an environment free from intimidation, harassment, defamation and discrimination
- Right to complain about bullying, harassment, defamation and discrimination, provided that the complaint is not frivolous or unfounded.
If you've suffered any of the above, you might think:
- Chat directly with the person (only if you feel capable, safe and confident to do so). You can talk directly to the person involved and advise that their behavior is unacceptable and should stop
- Seeking advice and/or support. You can talk to your supervisor or Manager. This person can help you explore resolution options
- Filing a complaint. You can file a complaint and all reports and complaints of harassment, intimidation, defamation and unlawful discrimination will be taken seriously and dealt with promptly, impartially and confidentially.
Violations of this policy may be subject to possible disciplinary action under IntelliSoft's Laws and Regulations.
